Beware of Fake Income Tax Notices Circulating on WhatsApp
A spate of fraudulent WhatsApp messages is doing the rounds, falsely posing as official communications from the Income Tax Department and threatening Section 271(1)(c) penalty proceedings. These messages allege that an “inspection” has uncovered irregularities and warn of possible prosecution under Section 276C if the assessee fails to act within 72 hours.
These communications are not genuine Income Tax notices. They are classic phishing attempts aimed at stealing personal data, login credentials, or infecting devices with malicious software. Assessees must be extremely cautious and should understand how to differentiate between a genuine departmental communication and a fake WhatsApp message.
Important: The Income Tax Department does not serve statutory notices, assessment orders, or penalty communications through WhatsApp.
This advisory explains how the fake message is structured, why it is fraudulent, what constitutes an authentic Income Tax communication, and the practical steps every assessee should take to stay safe.
The Fake WhatsApp Income Tax Penalty Message – What It Says
Fraudsters typically circulate a message that appears formal and official, often reproducing letterhead-like details and references to the Income Tax Department. A sample of such a bogus communication is as follows:
Income Tax Department of India
Aayakar Bhawan
New Delhi – 110001OFFICE MEMORANDUM
Tax Compliance Deficiency and Penalty Notice
The tax inspection of your company has revealed irregularities under Section 271(1)(c) of the Income Tax Act, 1961. You are required to review the attached penalty-related documents and complete the required procedures within 72 hours (3 days) from the date of receipt of this notice. Failure to comply within the stipulated period may result in further legal action under Section 276C of the Income Tax Act, 1961.
(*** ***** *****)
Assistant Commissioner of Income Tax
At first glance, the combination of a government address, references to Section 271(1)(c) and Section 276C, and mention of an “Assistant Commissioner of Income Tax” can easily mislead an unsuspecting assessee into believing that the notice is authentic. However, multiple features of this message reveal that it is a scam.
Why This WhatsApp Notice Is Clearly Fraudulent
1. No Statutory Notices Are Served via WhatsApp
The Income Tax Department follows structured, verifiable communication channels. Official notices and orders are not issued through social messaging platforms. Genuine communications are normally made through:
- The official Income Tax e-Filing Portal
- Registered email ID of the assessee as per the records
- SMS alerts (usually only informational and without attachments)
- Physical notices or letters where applicable in specific cases
Key statutory documents such as:
- Notices for assessment or reassessment
- Penalty initiation and penalty orders
- Summons
- Prosecution-related communications
are never validly served on WhatsApp. Any message claiming to be such a statutory notice on WhatsApp is inherently suspicious.
2. Dangerous Attachments – A Classic Phishing Technique
The fraudulent message directs the recipient to review “attached penalty-related documents”. This is one of the most common tricks in cyber fraud.
