In a significant verdict concerning social welfare legislation, the Supreme Court of India has reinforced the sanctity of factual findings recorded by the Commissioner under the Workmen’s Compensation Act, 1923. The Apex Court, in the matter of Panganti Vijaya Vs United India Insurance Company Ltd. & Ors., set aside a High Court judgment that had reversed a compensation award.
The ruling establishes a critical precedent: High Courts, while exercising appellate jurisdiction, cannot overturn well-reasoned factual findings regarding the employer-employee relationship, especially when the employer admits to the employment status during cross-examination, despite an initial denial in pleadings.

The Employment and the Accident
The deceased individual, Panganti Suresh, was engaged as a driver by the fifth respondent (the vehicle owner). The terms of employment included a monthly salary of Rs. 3,500.
On the date of 10.09.2004, at approximately 5:30 a.m., the deceased was driving a car bearing registration number AP-15L-4000. While returning from Hyderabad, the vehicle was involved in a severe collision with a lorry approaching from the opposite direction. The impact was catastrophic; out of the four occupants in the car, two individuals, including the driver Panganti Suresh, sustained fatal injuries and passed away.
The Compensation Claim
Following the demise of the breadwinner, the appellant (the legal representative of the deceased) initiated a claim petition under the Workmen’s Compensation Act, 1923. The primary contention was that the deceased was an employee of the fifth respondent and that the death occurred out of and in the course of his employment. Consequently, the claimant sought statutory compensation from both the employer and the insurer.
