Particulars Details
Case Name Poonam Promoters and Developers Pvt. Ltd. Vs ACIT (ITAT Delhi)
Appeal Number ITA No.4785/Del/2015
Date of Order 23/01/2024
Assessment Year 2005-06
Forum Income Tax Appellate Tribunal, Delhi

Background of the Dispute

The present case arose from assessment proceedings initiated under Section 153A of the Income Tax Act, 1961, wherein the Assessing Officer made an addition of ₹50 lakh to the income of Poonam Promoters and Developers Pvt. Ltd. for Assessment Year 2005-06. The addition pertained to certain entries recorded in the assessee's books of account, specifically relating to the sale of investments to Narmata Marketing Private Limited and Passion Chits Private Limited, which were credited in the assessee's books.

The genesis of the proceedings lay in a search and seizure operation conducted at the premises of BPTP Limited, along with its group concerns and associated persons, on 07.12.2010, which was ultimately concluded on 05.02.2011. Following this search, the Assessing Officer issued a notice under Section 148 of the Income Tax Act, 1961, dated 29.03.2012 — more than a year after the conclusion of the search operation.

The assessee challenged the additions before the Commissioner of Income Tax (Appeals)-30, New Delhi, whose order dated 27.03.2015 confirmed the Assessing Officer's action. Aggrieved by this outcome, the assessee filed an appeal before the Income Tax Appellate Tribunal, Delhi.

Grounds Raised by the Assessee

The assessee's grievances before the Tribunal were articulated as follows:

  1. The orders passed by both the Assessing Officer and the CIT(A) were bad in law and void ab initio.
  2. The CIT(A) erred in confirming the addition of Rs. 50,00,000/- as income from undisclosed sources.
  3. The assessment order suffered from violation of principles of natural justice, rendering it void ab initio.
  4. The assessee reserved the right to add, amend, alter, or vary any of the grounds.

Additionally, the following supplementary ground was placed on record:

"That on the facts and circumstances of the case and in law, the order passed u/s 153A by the Assessing Officer as confirmed by the Commissioner of Income Tax (Appeals) is bad in law and void ab initio and only deserves to be quashed as addition made by AO is not based on any incriminating seized document found during search which belong to assessee and relate to year under consideration during the course of search on 07.12.2010 being an undisputed position by the CIT(A) himself."

The central question before the Tribunal was whether, in a case where the assessment for AY 2005-06 had already stood completed as on the date of the search, an addition could be made under Section 153A of the Income Tax Act, 1961 in the absence of any incriminating material discovered during the search and seizure operation.
