Background and Facts of the Case
The assessee, an individual carrying on business in contract works, had duly filed his returns of income for the three assessment years in question. The sequence of events that gave rise to the dispute began with a search operation conducted under Section 132 of the Income-tax Act, 1961, at the premises of a third party, Shri Ashok Kumar Chowta. During the course of this search, a diary was seized that purportedly contained entries recording payments alleged to have been made to the assessee.
Following the search at Shri Chowta's premises, the Revenue authorities also conducted a survey at the assessee's own business premises, during which his statement was recorded. In the course of this statement, the assessee agreed to offer 8% of additional receipts as income. However, no revised returns were subsequently filed by the assessee in accordance with this admission.
On the basis of the material gathered through the above proceedings, the Assessing Officer issued notices under Section 148 of the Income-tax Act, 1961, and thereafter completed reassessment proceedings for all three assessment years, making additions to the assessee's income. The assessee challenged these additions before the Commissioner of Income Tax (Appeals), who partly allowed the appeals. Both the assessee and the Revenue carried their respective grievances to the Income Tax Appellate Tribunal, which partly allowed the appeals and cross-objections. Significantly, the ITAT reversed the decision of the Commissioner (Appeals) with respect to the Section 69B addition pertaining to Assessment Year 2007-08.

Assessee's Submissions
The assessee's primary contention before the High Court was that the entire basis of the reassessment proceedings rested on material that had been seized during a search conducted at the premises of a third party — namely, Shri Ashok Kumar Chowta — and not at the assessee's own premises. It was argued that when reassessment is sought to be made on the basis of documents or materials found during a search pertaining to another person, the applicable statutory mechanism is Section 153C of the Income-tax Act, 1961, and not Section 147.
The assessee placed reliance on Manish Maheshwari v. ACIT and Commissioner of Income Tax v. IBC Knowledge Park (P.) Ltd., contending that Section 153C operates as a special and overriding provision in scenarios where search material relating to another person forms the foundation of the assessment proceedings.
