REX Registration for Indian Exporters: Eligibility, Process, Documents and Compliance Obligations
Introduction
Indian exporters engaged in sending goods to overseas markets often seek to benefit from preferential customs duty treatment available under applicable trade preference arrangements. One of the key mechanisms through which such preferential origin can be certified is the Registered Exporter System, commonly referred to as REX. Understanding how REX works, who is eligible, what documents are needed, and what compliance obligations follow registration is essential for any exporter looking to leverage this self-certification facility effectively.
This article provides a structured overview of REX registration — from its basic concept to the ongoing compliance responsibilities that registered exporters must fulfil.
What is the Registered Exporter System (REX)?
The Registered Exporter System (REX) is a self-certification mechanism that allows eligible registered exporters to declare the preferential origin of their goods directly on commercial documents such as invoices, rather than obtaining a separate certificate of origin for each qualifying consignment. This declaration is referred to as a Statement on Origin.
For Indian exporters, REX is most prominently associated with the EU Generalised System of Preferences (EU-GSP), under which exporters holding a valid REX number are authorised to self-certify that their goods originate from India and therefore qualify for preferential tariff treatment in the European Union.
Critical Point: Obtaining a REX registration number does not automatically mean that every export shipment will attract preferential customs duty in the destination country. The eligibility of each consignment depends on the destination country, the applicable preference scheme, the product's HS/ITC-HS classification, and satisfaction of the relevant Rules of Origin.
Who is Eligible to Consider REX Registration?
REX registration is not limited to a specific type of business entity. The following categories of exporters may be eligible to apply, provided they are exporting qualifying products to eligible destinations under applicable preferential arrangements:
- Manufacturer Exporters
- Merchant Exporters
- Private Limited Companies
- LLPs and Partnership Firms
- Proprietorship Firms
- Other eligible IEC holders exporting qualifying products
Before initiating the registration process, exporters must verify the following:
- The correct HS/ITC-HS Code of the product being exported
- The destination country and its applicability under a REX-linked preferential scheme
- The applicable preferential scheme and whether REX is an accepted certification mechanism under it
- The Rules of Origin that the product must satisfy
Failure to conduct this preliminary verification can result in incorrect or unsupported Statements on Origin, which carry serious compliance consequences.
Documents Required for REX Registration
The documentation requirement may vary depending on the nature of the exporter's business and the expectations of the competent Local User or registration authority. However, exporters should generally be prepared to furnish the following:
Entity and Identity Documents
- IEC (Importer Exporter Code) along with an updated Importer Exporter Profile
- Certificate of Incorporation or relevant business registration document
- Company PAN
- GST Registration Certificate
- Memorandum and Articles of Association (MOA & AOA), wherever applicable
- Registered office or business address proof
- Authority Letter or Board Resolution authorising the signatory
- PAN and Aadhaar of the Authorised Signatory
- List of Directors or Partners, as applicable
