At the heart of this litigation lies the deputation and eventual absorption of four officers — Shri Pradeep Atri, Shri Praveen Chaudhary, Shri Pankaj Gaur, and Shri Arun Bhatia — originally appointed through the Haryana Public Service Commission to serve as Sub-Divisional Officers (Panchayati Raj) in the Development and Panchayat Department, Government of Haryana. Over a period of time, these four officers were moved on deputation to the Public Works Department (Buildings and Roads), Government of Haryana — referred to hereafter as the PW(B&R) Department — and were subsequently absorbed into that department against vacancies specifically earmarked for direct recruits in the cadre of Assistant Engineer (Civil) / Sub-Divisional Engineer.

This absorption was carried out without any of these officers competing in the open competitive recruitment process mandated for such appointments. The justification offered by the government was grounded in Rule 10 of the Punjab Service of Engineers, Class II, P.W.D. (Buildings and Roads Branch) Rules, 1965 (hereinafter referred to as "the 1965 Rules"), which permits appointment by transfer only in "special circumstances" and with the prior approval of the Public Service Commission.

The directly recruited Assistant Engineers in the PW(B&R) Department challenged both the absorption of these four officers and the seniority positions assigned to them — particularly the placement of deputationists above officers who had secured their appointments through open competition.


Factual Trajectory of Each Officer's Case

Shri Pradeep Atri

Shri Pradeep Atri was appointed on 06.12.2004 as Sub-Divisional Officer (Panchayati Raj) in the Development and Panchayat Department on the recommendation of the Haryana Public Service Commission on a temporary, probationary basis. Even before completing one year of probation, he personally wrote to the Engineer-in-Chief of the PW(B&R) Department on 14.07.2005 requesting deputation.

The PW(B&R) Department's Engineer-in-Chief recommended his deputation on 03.08.2005, citing acute shortage of Sub-Divisional Engineers and proposing that such deputation be treated as a stop-gap arrangement against a direct recruit vacancy until regular recruits joined. Though the request was initially "filed" by the State Government on 24.08.2005, Shri Atri renewed his request on 12.09.2005 and again on 15.09.2005, emphasising his keenness to serve in the PW(B&R) Department.

By a file notation dated 19.10.2005, his deputation was approved as a temporary stop-gap arrangement with a condition that he could be sent back to his parent department at any time. He was accordingly relieved from the Development and Panchayat Department on 16.11.2005 and joined the PW(B&R) Department on 17.11.2005 for a one-year period.

Remarkably, within just three months of joining on deputation, Shri Atri submitted a request dated 24.02.2006 seeking permanent absorption. Meanwhile, the PW(B&R) Department had already sent a requisition to the Haryana Staff Selection Commission on 03.03.2006 for filling 44 vacancies of Sub-Divisional Engineer through direct recruitment, followed by a public advertisement on 07.05.2006.

Critically, Shri Pradeep Atri applied for the post of Assistant Engineer (Civil) in the PW(B&R) Department pursuant to the advertisement dated 07.05.2006 but failed to qualify when the select list was published on 13.11.2006.
