NCLAT Delhi Refuses to Condone 202-Day Refiling Delay Blamed on Counsel's Family Illness
In re Rajendra Devidas Puranik (NCLAT Delhi), the National Company Law Appellate Tribunal rejected I.A. No. 6046 of 2026, which sought condonation of a 202-day delay in refiling Company Appeal (AT) No. 326 of 2026, and dismissed the appeal.
Background
The appellant is the Liquidator of M/s Brown Packaging Systems Pvt. Ltd. He appealed against an order dated 08.12.2025 of NCLT Mumbai, passed on I.A. (Companies Act)/242(MB) 2025 in C.P. No. 20(MB)/2024. That order partly allowed his application on remuneration, restricting it to Rs 4,00,000 plus GST, in addition to the amount payable under Regulation 4 of the IBBI Liquidation Regulations. His grievance was that this departed from the remuneration approved by contributories and creditors at the fifth meeting on 23.10.2025, and from the Companies Act, 2013 and the Companies (Winding Up) Rules, 2020.
