MPREAT Rules: Joint Venture Disputes Between Landowners and Developers Excluded from RERA Jurisdiction

In a significant verdict that delineates the jurisdictional limits of the Real Estate Regulatory Authority, the Madhya Pradesh Real Estate Appellate Tribunal (MPREAT) has ruled that disputes stemming from Joint Venture (JV) or collaboration agreements between a landowner and a developer are outside the purview of the Real Estate (Regulation and Development) Act, 2016.

Delivering the judgment on 08 January 2026 in the matter of Bhopal Development Authority vs. Roop Laxmi Singh, the Tribunal established that a landowner who contributes land for a project acts in the capacity of a co-promoter rather than an "allottee." Consequently, such landowners are precluded from seeking legal recourse against the developer under the provisions of RERA.

Factual Matrix of the Case

The legal controversy originated from a registered Joint Venture Agreement executed on 22 August 2012. The parties involved were:

  1. The Respondent: The owner of a land parcel measuring 0.37 acres located at Khasra No. 354/3.
  2. The Appellant: Bhopal Development Authority, tasked with the development of the real estate project.

Terms of the Agreement

The crux of the arrangement was a collaboration wherein the Appellant was obligated to develop a real estate project on the Respondent's land. In exchange for granting development rights, the Respondent was entitled to receive a semi-developed plot, specifically identified as Plot No. 23, spanning an area of 6,527 square feet.

The Dispute

While the Appellant successfully secured the necessary regulatory permissions and initiated the development work, the project faced delays. Crucially, the Appellant failed to hand over the agreed-upon plot to the Respondent within the stipulated timeline.

With the advent of the Real Estate (Regulation and Development) Act, 2016, the project was classified as an ongoing project, necessitating its registration with the RERA Authority by the Appellant. Grievanced by the non-delivery of the plot and alleging a breach of the Joint Venture Agreement, the Respondent filed a complaint before the RERA Authority.
