Madhya Pradesh High Court Mandates SMS and Email Alerts for GST Hearing Notices to Prevent Ex-Parte Dismissals

The transition to a fully digital tax administration under the Goods and Services Tax (GST) regime has undoubtedly streamlined compliance and assessment procedures. However, this digital shift has also introduced unique procedural bottlenecks, particularly concerning the communication of statutory notices. A recurring grievance among the assessee community is the uploading of critical hearing notices under obscure sections of the GST portal, such as the "Additional notices/Orders" tab, without accompanying electronic alerts. This often leads to missed hearings and subsequent ex-parte dismissals.

Addressing this systemic issue, the Madhya Pradesh High Court recently delivered a pragmatic judgment in the case of Maple Overseas Trade Private Limited Vs State of Madhya Pradesh And Others. The Court not only restored an appeal dismissed for non-prosecution but also issued a crucial advisory to the GST Department. The judiciary recommended the implementation of an auxiliary communication mechanism—specifically SMS and email alerts—to notify the assessee or their authorized representatives about hearing dates, thereby mitigating unnecessary litigation stemming from technical communication failures.

Factual Matrix of the Dispute

The legal controversy originated when the Deputy Commissioner of State Tax, Indore Division, issued an order dated 07.09.2022 against the assessee, Maple Overseas Trade Private Limited. This order crystallized a substantial tax demand amounting to Rs. 81,46,488/-.

Aggrieved by this assessment, the assessee exercised its statutory right to appeal and filed the same before the Joint Commissioner of State Tax (Appellate Authority) Division-I on 17.10.2022. To ensure the maintainability of the appeal, the assessee fulfilled the statutory requirement by making a pre-deposit of Rs. 6,04,788/-. The appellate forum formally accepted this pre-deposit on 20.12.2023.

Following the acceptance, the Appellate Authority issued a notice for a personal hearing on 20.12.2023. Subsequent notices were purportedly issued on 09.02.2024, 21.03.2024, and 02.03.2026. Crucially, all these communications were exclusively uploaded to the GST portal under the "Additional notices/Orders" tab.
