Gujarat High Court Quashes Time-Barred Reassessment Notice Under Section 148 for AY 2014-15

Overview of the Case

The Gujarat High Court ruled in favour of the assessee in Sorathia Mahesh Veljibhai HUF Vs ITO (Gujarat High Court), allowing a writ petition that challenged the reopening of an income tax assessment for Assessment Year 2014-15. The Court found that the reassessment proceedings were hit by limitation and accordingly quashed the impugned notice and order.

Background and Constitutional Challenge

The assessee — Sorathia Mahesh Veljibhai HUF — approached the Gujarat High Court by way of a petition under Article 226 of the Constitution of India. The challenge was directed against two instruments, both dated 30 July 2022:

  1. A notice issued under Section 148 of the Income Tax Act, 1961
  2. An order passed under Section 148A(d) of the Income Tax Act, 1961

Both instruments pertained to the reopening of the assessee's income tax assessment for AY 2014-15.

The assessee's primary grievance was that the notice and the consequential order suffered from a fundamental infirmity — they were issued beyond the permissible limitation period and therefore lacked legal validity and jurisdictional competence.

Reliefs Sought Before the High Court

The assessee prayed for the following reliefs before the Gujarat High Court:

"(a) quash and set aside the impugned notice as well as the impugned order at ANNEXURE "A (COLLY.)" to this petition; (b) pending the admission, hearing and final disposal of this petition, stay the implementation and operation of the impugned notice as well as impugned order at ANNEXURE "A (COLLY.)" to this petition and stay further proceedings for Assessment Year 2014-15; (c) any other and further relief deemed just and proper be granted in the interest of justice; (d) provide for the cost of this petition."

These prayers collectively sought interim protection against the implementation of the reassessment machinery as well as final relief by way of quashing both the Section 148 notice and the Section 148A(d) order.

What is Section 148?

Section 148 of the Income Tax Act, 1961 empowers the Assessing Officer to issue a notice to an assessee where income is believed to have escaped assessment. Such a notice is the foundational step for initiating reassessment proceedings. However, this power is not unlimited — it is circumscribed by strict limitation periods, and any notice issued beyond the prescribed time limit is void ab initio.
