Extension of Minimum Import Price on ATS 8 Imports Under Chapter 29 Until 30.11.2026

The Directorate General of Foreign Trade (DGFT) has extended the existing Minimum Import Price (MIP) requirement on imports of ATS 8, a specific chemical falling under Chapter 29 of ITC (HS), 2022, Schedule-I (Import Policy). This continuation has been formalised through Notification No. 39/2026-27-DGFT dated 30 September 2026, and the MIP now applies up to 30 November 2026.

This article explains the legal basis of the extension, the exact scope of the MIP, relevant ITC (HS) codes, and the practical implications for importers and other stakeholders.

Statutory and Policy Framework

The Central Government has relied on its authority under:

  • Section 3 of the Foreign Trade (Development & Regulation) Act, 1992
  • Section 5 of the Foreign Trade (Development & Regulation) Act, 1992

These provisions empower the Government to regulate imports and exports and to frame and modify the export-import policy.

Linkage With Foreign Trade Policy 2023

The notification specifically references:

  • Paragraph 1.02 of the Foreign Trade Policy 2023
  • Paragraph 2.01 of the Foreign Trade Policy 2023

These paragraphs enable the Government to issue and modify policy-related instructions, including conditions attached to import authorisations and the import policy for specific items. The present extension of MIP for ATS 8 is therefore anchored both in the statute and in the broader Foreign Trade Policy framework.

Background: Earlier Imposition of MIP

Original MIP Notification

The MIP condition on ATS 8 was initially brought into effect through:

  • Notification No. 30/2025-26 dated 18.09.2025

That earlier notification introduced a Minimum Import Price of USD 111 per Kg on the Cost, Insurance and Freight (CIF) value for imports of ATS 8 falling under specified ITC (HS) codes in Chapter 29 of ITC (HS), 2022, Schedule-I (Import Policy).

Continuity of the Earlier Conditions

The new Notification No. 39/2026-27-DGFT does not alter the substantive conditions originally prescribed. Instead, it only extends the duration of the pre-existing MIP condition up to 30.11.2026, while clearly stating that all other terms and conditions of Notification No. 30/2025-26 remain unchanged.

Key Point: The extension is purely temporal in nature. There is no modification to the MIP rate, item description, or applicable ITC (HS) codes as earlier notified.

Scope of the MIP Requirement

Product Covered: ATS 8

The MIP condition applies specifically to imports of:

ATS 8 [(4R-Cis)-1,1-Dimethylethyl-6-cyanomethyl-2,2-dimethyl-1,3-dioxane-4-acetate]

This is a particular chemical falling under Chapter 29, and it continues to be subject to a regulated minimum import value under the import policy.

Applicable ITC (HS) Codes

The MIP requirement at USD 111 per Kg on CIF basis applies where ATS 8 is imported under any of the following ITC (HS) 2022 Schedule-I (Import Policy) codes:

  • 29329990
  • 29339990
  • 29333990
  • 29321990
  • 29349990
  • 29420090
  • 29189990
  • 29159099
  • 29163990
  • 29225090

Importers declaring ATS 8 under any of these headings will be expected to comply with the MIP condition as extended.
