CESTAT Mumbai Partly Allows MIRC Electronics' CENVAT Credit Appeal: Detailed Analysis of Input Service Eligibility Under Rule 2(l)
Background and Overview
CESTAT Mumbai delivered a significant ruling in MIRC Electronics Ltd Vs Commissioner of CGST Bhiwandi (CESTAT Mumbai), partly deciding in favour of the assessee on the question of CENVAT credit eligibility on multiple categories of input services. The dispute centred on whether certain services availed by the assessee — a manufacturer of electronic and electrical goods — qualified as "input services" within the meaning of Rule 2(l) of the CENVAT Credit Rules, 2004.
The assessee is engaged in the manufacture of electronic and electrical goods classified under Chapter headings 8528, 8450, 8529, and 8415 of the First Schedule to the Central Excise Tariff Act, 1985. In the ordinary course of its manufacturing operations, the assessee availed CENVAT credit of service tax paid on several categories of services, including Brokerage & Commission, Detention Charges, Insurance Services, Membership Fees, Rent-a-Cab (Conveyance), and Staff Welfare Expenses.
Genesis of the Dispute
The Department's audit wing initially raised objections to the availment of CENVAT credit on the above-mentioned services, contending that these did not fall within the definition of "input service" as prescribed under Rule 2(l) of the CENVAT Credit Rules, 2004. Following the audit report, Show Cause Notices (SCN) dated 11.01.2018 and 15.05.2018 were issued to the assessee.
Upon adjudication, the original authority confirmed the proposals in both SCNs vide order dated 18.12.2018, imposing a penalty of 50% of the irregularly availed CENVAT credit under Rule 15 of the CENVAT Credit Rules, 2004 read with Section 11AC of the Central Excise Act, 1944. On appeal, the Commissioner (Appeals), GST and Central Excise, Appeals-Thane, upheld the denial of credit through the impugned order dated 25.06.2019, though the penalty quantum was reduced to 10% of the confirmed CENVAT demand. The assessee thereafter approached CESTAT Mumbai.
Statutory Framework: Understanding Rule 2(l)
Before addressing the individual service categories, the Tribunal undertook a structured examination of the definition of "input service" under Rule 2(l) of the CENVAT Credit Rules, 2004. The relevant provision reads as under:
