CBIC revises duty drawback All Industry Rates for gold and silver jewellery with effect from 15 October 2026
The Central Board of Indirect Taxes and Customs (CBIC) has revised the All Industry Rates (AIR) of duty drawback for select products falling under Chapter 71, specifically covering gold jewellery, silver jewellery, and articles of silver. The change has been implemented through Notification No. 85/2026-Customs (N.T.), dated 15 October 2026, which amends Notification No. 77/2023-Customs (N.T.), dated 20 October 2023.
The revision results in reduced duty drawback rates for three tariff items, and exporters dealing in these commodities must realign their pricing, costing, and documentation to the updated schedule.
Statutory framework for the amendment
The notification has been issued under the following enabling provisions:
Section 75of the Customs Act, 1962 (52 of 1962)`Section 37(2)of the Central Excise Act, 1944 (1 of 1944)`Rules 3 and 4of the Customs and Central Excise Duties Drawback Rules, 2017`
These provisions empower the Central Government to prescribe and revise duty drawback rates, including All Industry Rates, for goods exported out of India, so as to neutralise specified customs and excise duties embedded in export products.
The latest notification is a further amendment to the principal drawback notification, i.e. Notification No. 77/2023-Customs (N.T.), dated 20 October 2023, which provides the detailed Schedule of All Industry Rates across various chapters. The principal notification had earlier been amended by Notification No. 64/2026-Customs (N.T.), dated 16 July 2026; the present notification constitutes a subsequent modification confined to selected entries of Chapter 71.
Focus of the amendment – limited to specific Chapter 71 entries
The scope of Notification No. 85/2026-Customs (N.T.) is narrow and targeted. It does not overhaul the entire drawback schedule but only substitutes the figures in column (4) – the column that contains AIR of duty drawback – for three specific tariff items in Chapter 71.
The affected tariff items are:
711301– Articles of jewellery and parts thereof, made of gold711302– Articles of jewellery and parts thereof, made of silver711401– Articles made of silver
There is no change in the descriptions or any other columns for these entries. Only the numeric values of the duty drawback rates in column (4) have been replaced.
Note: Exporters should continue to classify their products under the same tariff items and follow the same conditions as earlier; only the applicable drawback amount has changed for these three entries.
