Extension of Anti-Dumping Duty on Normal Butanol Imports from Select Countries

Normal Butanol or N-Butyl Alcohol is classified under tariff item 2905 13 00 of the First Schedule to the Customs Tariff Act, 1975. The earlier levy of anti-dumping duty on this product had been imposed through Notification No. 21/2021-Customs (ADD) dated 12 April 2021. The recent amendment inserts a new paragraph clarifying the extended validity period of the duty.

Statutory basis for anti-dumping duty
The extension has been made by invoking the powers conferred under:
Section 9A(1)andSection 9A(5)of the Customs Tariff Act, 1975 (51 of 1975); andRule 18andRule 23of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 (commonly known as the Anti-Dumping Rules, 1995).
Under Section 9A, the Central Government may impose anti-dumping duty on imported goods that are found to be dumped and causing material injury to the domestic industry. Sub-section (5) read with Rule 23 further allows for the continuation of such duty during the pendency of a sunset review, to avoid a gap in protection.

The Designated Authority under the Directorate General of Trade Remedies (DGTR) plays a central role in:
- Initiating investigations and sunset reviews
- Assessing whether continued imposition of duty is necessary
- Recommending extension, modification or discontinuation of anti-dumping duty
